You have enough trouble keeping up with your life admin.
Imagine if something happened to you, a sudden catastrophic injury, how would your family be able to help you? The thing is, I actually think that planning for capacity issues is more important than preparing a Will.
Let’s get started
While I know that this is complicated, I am not here to tell you how complicated it is, and how clever I am at my job. I am here to help you get to work, I am not going to placate you by saying it is simple, but I am not going to give you a bunch of homework and then abandon you to your own timeline either.
What is the price?
I know, tell ‘em the price son. My price for a couple who are doing their decision making documents, online (so appointments by Google Meets) is $1,500 plus disbursements.
But if you want to know why I think it is so important, keep scrolling.
Why is it important?
There are a few problems with having no Power of Attorney if you lose capacity, including -
there are no intestacy provisions for financial decisions, no default person;
going to the Tribunal to get financial management orders normally means the Public Trustee will have oversite, and charge fees;
your family may fight over who the best person is to make your financial decisions; and
most disputes are about what the person would have wanted, you have discussed death, have you discussed loss of capacity?
Planning for loss of capacity, or less capacity and needing some support, is stressful but it is incredibly important.
